Art.1 Object<\/b><\/p>

The object of this contract is the graphic design and production of customised materials for events, in particular wedding invitations, invitations, graphic coordinates for ceremonies (baptisms, communions, anniversaries, etc.), and related products, offered by Macarena Gonz\u00e1lez - owner of the Plumacreativa business.<\/p>

Plumacreativa undertakes to provide these services according to the specifications agreed upon with the customer at the time of the order, placed through www.plumacreativa.it, or through direct agreements documented by e-mail.<\/p>

By placing an order, the Customer declares that he has read, understood and fully accepted these Terms and Conditions.<\/p>

Personal data provided by the customer will be processed in accordance with EU Regulation 2016\/679 (GDPR), as stated in the\u2019Privacy Policy.<\/span><\/a><\/p>

Art.2 Demonstration samples and correspondence with the final product<\/strong><\/p>

2.1 Demonstration samples<\/strong><\/em><\/p>

The customer can purchase one or more paper samples or the sample kit available on the website, in order to evaluate materials, papers, formats and print quality.<\/p>

Samples cannot be customised, and purchasing them does not entail any obligation to place a subsequent order.<\/p>

The samples are purely demonstrative. Since the final order is produced at a different time, the final product may present slight variations compared to the sample received, in particular regarding paper shade, print colours, finishes and accessories.<\/p>

2.2 On-screen colours<\/em><\/strong><\/p>

Colours displayed via computer, smartphone or tablet are for guidance only. Colour reproduction may vary depending on the calibration, brightness and settings of the device used by the Customer.<\/p>

Printing also uses different colour systems from those of screens. For this reason, it is not possible to guarantee an exact match between the digital preview and the printed product.<\/p>

Should a specific colour be requested, Plumacreativa will endeavour to achieve the closest possible shade to that indicated by the Customer. Any slight colour variations compatible with normal printing processes do not constitute a product defect.<\/p>

2.3 Handcrafted workmanship and tolerances<\/strong><\/em><\/p>

Plumacreativa products are printed, cut, folded, assembled and finished through partially artisanal processes. The dimensions shown on the website, in quotes, previews or commercial communications must therefore be understood as indicative.<\/p>

Minor variations in size, cut, print centring, creasing, folding, material bonding and the positioning of manually applied ribbons, seals, adhesives or other elements may occur.<\/p>

These characteristics are proper to artisanal workmanship and do not constitute a defect, provided they do not compromise the use of the product and do not determine a substantial discrepancy with respect to what was agreed.<\/p>

2.4 Material characteristics and variations<\/strong><\/em><\/p>

The materials used by Plumacreativa may exhibit slight irregularities and variations from one item to another. The final result may vary slightly depending on the type of paper, the chosen finish and the specific characteristics of each material.<\/p>

These differences are part of the nature of the materials and the craft production: they do not compromise the quality or use of the product and, within reasonable limits, are not considered non-conformities.<\/p>

Such variations may also be present among pieces belonging to the same order and represent a characteristic inherent to the material and artisanal production.<\/p>

Each product may therefore present small differences that highlight its uniqueness and which, within the limits described above, are not considered lack of conformity.<\/p>

2.5 Reprints, additions and subsequent orders<\/strong><\/em><\/p>

Reprints, additional copies, order supplements or processing requested at a later stage may exhibit slight differences compared to the original production.<\/p>

Variations may include, by way of example, the shade or texture of the paper, the colour and intensity of the print, the cut, the dimensions, the alignment, accessories and finishes.<\/p>

Plumacreativa will do everything reasonably possible to maintain continuity with previous production, but cannot guarantee a perfect match between work carried out at different times. Such slight differences do not constitute a product defect.<\/p>

Art.3 Acceptance of general sales conditions<\/b><\/p>

If the Customer intends to proceed with the purchase, he\/she must send telematic confirmation of his\/her purchase order, accepting the general and payment conditions described below, declaring that he\/she has read and accepted all the information provided to him\/her.<\/p>

The payment confirmation will start the actual processing of the order, according to the procedures described below.<\/p>

Art.4 Confirmation of the draft of the press and processing of the order<\/b><\/p>

The provisions of this article apply to orders placed through the \u201cTrust us\u201d graphic design service or the \u201cCustom graphics\u201d service. For invitations purchased directly in the original template version, the conditions set out in Article 4-bis shall apply instead.<\/p>

  1. The Customer must confirm the order and specify the chosen service: the \u201cLeave it to us\u201d design service or the \u201cCustomised design\u201d service. Once the order has been placed, they must send the text and instructions by completing the form available at www.plumacreativa\/istruzioni, uploading or sending via email the text to be included on each element in digital format (Word or Excel) following the instructions that can be downloaded upon order confirmation.<\/li>
  2. The customer may decide to divide the order into two blocks: first order the invitations and then the wedding day co-ordinates. For each block, a maximum of 3 graphic previews are included, which cannot be accumulated between blocks.<\/li>
  3. Once payment has been made and this information has been sent, Plumacreativa will provide the Client with a digital preview of the print, which constitutes a FACSIMILE of the finished product. The Client may report any errors in the digital preview. For catalogue designs there are 3 digital previews; the request for modifications and elaboration of any new drafts will postpone the date of printing and delivery and will entail a surcharge.<\/li>
  4. The approval of the preview and the contents constitutes consent to the execution of the print, therefore with this \u201cfinal approval of the preview\u201d the selection process is considered to be completed. Any changes and\/or requests subsequent to the approval itself will not be possible. Errors in the preview approved by the Client, whether spelling or typing errors, cannot be attributed to Plumacreativa, and remain the sole responsibility of the Client, who must bear the costs of reprinting. Proofs serve not only to assess the aesthetic side but also to verify the information and texts contained.\u00a0<\/li>
  5. Once the digital preview has been approved, you will be asked to make the remaining payment by bank transfer. Only then will the approved files be sent to the print shop. Your invitations and coordinates will be carefully packaged, wrapped and shipped. This process takes at least 10-15 working days from receipt of payment. In the case of subsequent reprints, over
    printing costs, the cost of reopening the order and, if necessary, the additional cost for re-dispatch will have to be covered.<\/li>
  6. The customer may decide to order additional graphics in a second block; the graphics and layout for each additional element will have a cost marked on the site at the time of the request. Quantities may be changed until they are sent to the print shop; in this case, the quotation will be updated with the new quantities. For the second block, 3 previews are included; each additional preview will have an extra cost marked on the website. If the Client decides not to proceed with the printing of any graphic element for which Plumacreativa has already provided the digital proof, the fee for the graphics and layout for that element must still be paid, without the print file being provided.<\/li>

  7. Plumacreativa does not supply the digital files of the graphics created for printing. Each order includes exclusively the supply of the printed products, as agreed with the Client. The eventual cession of digital files will be evaluated on a case-by-case basis and can only take place in cases where it is effectively necessary. In this case, the file will be supplied against payment of a specific cost, indicated on the Plumacreativa website at the time of the request. It is specified that the purchase of graphics for printing does not confer any right to use or modify the digital files by the Client for other purposes.\u00a0<\/p><\/li><\/ol>

    Art. 4bis Direct purchase of the original model<\/strong><\/p>

    The Customer can purchase invitations directly in the original version of the selected design, choosing on the website the quantity, composition, paper, any envelope and other options available in the configurator.<\/p>

    With this mode, fonts, colours, decorations, illustrations and layout remain identical to the template shown on the website. Direct purchase does not include graphic design or revision, the preparation of alternatives, or the possibility of requesting changes.<\/p>

    At the time of ordering, the Customer must enter the text and data necessary for the preparation of the invitations and confirm that they have carefully verified their correctness. The data transmitted with the order are considered final and cannot be modified subsequently.<\/p>

    The Customer will receive a single digital proof, intended exclusively to verify that the data received has been transcribed correctly and to authorise printing. The proof does not constitute a project review phase and does not allow requests for variations, alternative graphics, or modifications to the texts and data originally sent.<\/p>

    Should the preview show a discrepancy introduced by Plumacreativa compared to the data submitted with the order, this discrepancy will be corrected free of charge. However, errors, omissions or inaccurate information already present in the data provided by the Client shall not be considered free corrections.<\/p>

    For any changes to the texts or data sent, as well as to modify fonts, colours, decorations, illustrations or layout, it will be necessary to purchase the \u201cLeave it to us\u201d full design service.<\/p>

    Production will commence exclusively after print authorisation. With the approval of the proof, the Customer definitively confirms the correctness of the content and authorises Plumacreativa to proceed. Any errors approved by the Customer cannot be blamed on Plumacreativa and any subsequent reprints will be entirely at the Customer's expense.<\/p>

    The preview will normally be sent within 3 working days of the order. Production times are approximately 15 working days from print approval, barring special processing, unavailability of materials or causes beyond Plumacreativa's control.<\/p>

    Items purchased directly will be delivered separately and must be assembled by the Customer. The colour of the envelopes can be chosen exclusively from those available in the configurator. Handmade envelopes, special formats, custom finishes, accessories not featured in the configurator and wedding stationery suites are available exclusively through the \u201cLeave it to us\u201d graphic design service.<\/p>

    Payment for the direct purchase is made in full at the time of order and includes exclusively the products and options selected in the configurator, in addition to the shipping and taxes indicated in the basket.<\/p>

    Art.5 Terms and methods of payment<\/b><\/p>

    Plumacreativa offers different purchasing methods, each subject to the conditions and payments indicated on the relevant page of the website.<\/p>

    With the \u201cLeave it to us\u201d graphic design service or the \u201cCustomised graphics\u201d service, upon order confirmation the Customer is required to pay the amount due for the chosen service. Payment initiates the graphic design work, developed on the basis of the texts, instructions and any materials provided by the Customer, and includes the number of graphic previews specified on the website.<\/p>

    The initial payment relates exclusively to the graphic design service. Following final approval of the design, the Client will receive the production invoice, calculated according to the chosen quantities, paper, envelopes, accessories and finishes. The balance of the remaining amount will be required to proceed with printing and production.<\/p>

    Should the Customer decide to cancel the order after graphic work has commenced, the amount paid for the service shall be retained by Plumacreativa as remuneration for the work already carried out.<\/p>

    With the direct purchase of the original model, the Customer is instead required to pay the full amount indicated in the cart at the time the order is placed. The price includes the products, quantities and options selected in the configurator, as well as the shipping and taxes indicated in the order summary.<\/p>

    Confirmation of payment triggers the processing of the order in accordance with the selected purchase method and the relevant terms set out in the preceding articles.<\/p>

    Art.6 Communication<\/b><\/p>

    All communication regarding the order shall be made exclusively by email, no requests by voice or other communication channels will be processed.\u00a0<\/p>

    Art 7: Processing, production and delivery times<\/strong><\/p>

    The times indicated on the website, in quotes and in communications relating to the order are expressed in working days and are to be considered indicative, unless Plumacreativa has expressly confirmed a specific delivery date in writing.<\/p>

    The time required to prepare design proofs is not included in the production lead times. This may vary depending on the service chosen, the complexity of the project, the completeness of the materials supplied and the client\u2019s response times.<\/p>

    Production takes approximately 15 working days and begins upon final approval of the proof and, where applicable, upon receipt of the balance. Accessories, handcrafted elements, special formats or specific printing methods may require additional time, which will be communicated to the Customer.<\/p>

    For orders placed through the graphic design service, any request for modification or a new preview may delay the start of production by approximately 2\u20135 working days. For direct purchases of the original template, however, it is not possible to request modifications or additional previews, in accordance with Art. 4-bis.<\/p>

    Any delays on the part of the Client in submitting texts, instructions, materials, approvals or payments will result in a corresponding delay in processing, production and delivery times.<\/p>

    Urgent orders \u2013 that is, those for which production is requested within 15 working days of final approval \u2013 are subject to a prior feasibility assessment by Plumacreativa. Should the urgent order be accepted, a surcharge may be applied, approximately equal to 15%, which will be communicated to the Customer prior to confirmation.<\/p>

    Delivery costs are payable by the Customer and are shown in the shopping basket, the quotation or the final invoice, depending on the purchase method selected. Delivery will be made by express courier at the cost indicated on the website or in the order documentation.<\/p>

    Upon delivery, the Customer is requested to check the integrity of the package and promptly report any anomalies, damage or missing items, keeping the packaging and providing photographs useful for verification. Plumacreativa will manage the report and, when necessary, initiate the relevant claim procedure with the courier.<\/p>

    The delivery times communicated by the courier are indicative and may be subject to variations due to causes not directly controllable by Plumacreativa. Any delays by the carrier do not alter the rights granted to the Customer by current legislation.<\/p>

    Processing, production and delivery times may also be subject to variation in the event of unforeseen circumstances or circumstances beyond Plumacreativa's control, including, by way of example, unavailability of or delays in the supply of materials, technical breakdowns, illness, emergencies, weather events, strikes, transport disruptions or other causes of force majeure.<\/p>

    Plumacreativa will inform the Client as soon as it becomes aware of a potential delay and will take all reasonable steps to limit the consequences and complete the order as quickly as possible.<\/p>

    Art.8 Bagging and Assembly<\/b><\/p>

    Invitations purchased directly in the original version of the design come with all elements separate, to be assembled by the Customer.<\/p>

    For orders placed through the graphic design service, any envelope insertion or assembly must be explicitly stated in the quote or order summary. In the absence of such an indication, the various items will be supplied separately.<\/p>

    Assembly may include the insertion of cards into envelopes, the application of accessories and any final processes specifically agreed upon.<\/p>

    Art.9 Prices\u00a0<\/b><\/p>

    The prices of products from time to time published in the catalog cancel and replace the previous ones (stop the prices of orders previously confirmed by the customer) and are subject to the actual availability of the materials offered by the suppliers.<\/p>

    Plumacreativa does not guarantee the availability of all the products present in the advertising material, as the supplying companies can interrupt supplies without notice. Plumacreativa therefore reserves the right to confirm or modify the prices and availability of the products, at the time of the confirmation of the client's order.<\/p>

    The quotation sent by e-mail at the Customer's request is valid for 30 working days. Once this period has elapsed without the Client having confirmed the order, the Client assumes the full risk of any price updates that may have occurred in the meantime. In any case, before the 30 days have elapsed from the transmission of the estimate by e-mail, Plumacreativa reserves the right to cancel the estimate, unless it has already been confirmed by the client.<\/p>

    Art.10 Copyright<\/b><\/p>

    All products, designs and elements created by Plumacreativa are the exclusive property of Plumacreativa and may not be reused or reproduced, some designs use illustrations of third parties for which Plumacreativa has the right of commercial use.<\/p>

    With the customised graphics service, Plumacreativa will create an ad-hoc design according to the customer's wishes; this design may contain illustrations created by third parties for which Plumacreativa has the rights of use.<\/p>

    Customised designs remain the property of Plumacreativa, the customer will have the exclusivity of that design and Plumacreativa will not offer that design to other customers, it may, however, be an inspiration for different designs.\u00a0<\/p>

    Whatever the service purchased, the customer may not use the designs, logos, monograms or motifs of Plumacreativa on any merchandise, website, cakes, favours, photocopies, paper products or other items without the express permission of Plumacreativa. No other company may use or reproduce the graphic material without the right of use.<\/p>

    Plumacreativa may use the photos of the material created for publicity purposes. If you do not want the photos to be published, you must make a written request to the email address info@plumacreativa.it<\/span><\/a>\u00a0<\/span><\/p>

    Art.11 Wedding website service<\/i><\/b><\/p>

    Plumacreativa, through the methods described below, offers customers the possibility of having a website dedicated to their wedding; this is an optional paid service offered as a complement to paper invitations.<\/p>

    The duration of the wedding website service is one year from the date of registration of the domain freely chosen by the customer. After this period, the customer may decide to renew the duration of their website for a further year.<\/p>

    Each website will be automatically referenced in search engines, this indexing is completely dependent on the search engines.<\/p>

    The customer has the option of restricting access to their website by adding a password; the dissemination of this password is entirely their responsibility.<\/p>

    There is no compensation or indemnity in the event of any interruption of service or temporary inability to access the website, whether for technical reasons or any other reason, plumacreativa undertakes to check and solve the problem encountered as quickly as possible.<\/p>

    The website and the published content are the complete responsibility of the client who provided the data, photos and texts for its realisation. Plumacreativa does not guarantee in any way the accuracy or rights of use of the published data and photos.<\/p>

    Plumacreativa is not liable if a user's visit to the site causes them damage or harm.<\/p>

    Art. 12 Right of withdrawal, guarantee and complaints<\/i><\/b><\/p>

    Products made by Plumacreativa are custom-made or clearly personalised based on instructions provided by the Customer. Therefore, pursuant to Article 59, paragraph 1, letter c) of Legislative Decree No. 206 of 6 September 2005 (\u201cConsumer Code\u201d), the right of withdrawal provided for distance contracts does not apply to such products.<\/p>

    For direct purchases of the original model, the texts and data entered become final upon submission of the order, pursuant to Article 4-bis. For orders placed through a graphic design service, the project becomes final upon approval of the digital proof. Following approval and authorisation to print, it will not be possible to request modifications or cancel production, without prejudice to the provisions of current legislation regarding conformity defects.<\/p>

    Before authorising printing, the Customer is required to carefully check the digital proof, verifying texts, names, dates, contact details, addresses, quantities, layout and any other information contained therein. Any errors in the proof approved by the Customer cannot be blamed on Plumacreativa. Any corrections or reprints requested subsequently shall therefore be borne by the Customer.<\/p>

    The Customer is invited to check the products upon delivery and promptly report any problems by writing to the email address indicated on the website, attaching photographs and a detailed description of the defect found.<\/p>

    The material subject to the complaint must not be used, modified, assembled or disposed of before being inspected by Plumacreativa. If it needs to be returned, Plumacreativa will inform the Customer of the relevant procedures.<\/p>

    In the event of a lack of conformity effectively attributable to Plumacreativa, the remedies provided for by current legislation will be applied. Where possible and proportionate to the nature of the defect, Plumacreativa will arrange for the remake or reprint of the items concerned, at no cost to the Customer. Should restoration of conformity not be possible, the further remedies provided for by the Consumer Code shall apply.<\/p>

    Minor colour, dimensional or finish variations and small irregularities inherent to materials, printing processes and artisanal workmanship, as described in Article 2, do not constitute lack of conformity, provided they do not compromise the use of the product and do not render it substantially different from what was agreed.<\/p>

    Art. 13 Conclusion of contract<\/i><\/b><\/p>

    The contract shall be concluded upon receipt by the Customer of the order acceptance e-mail. The e-mail will summarise the contractual conditions, product characteristics, price, shipping cost and payment method.<\/p>
